Nick Loeb, ex-fiancee of Sofia Vergara, loses appeal in battle over frozen embryos: Louisiana court rules in favor of Modern Family actress and upholds rejection of her lawsuit to obtain custody of pre-embryos

Sofia Vergara’s former fiance, Nick Loeb, lost another legal battle over pre-embryo custody rights.

The Fourth Circuit Court of Appeal in Louisiana ruled in favor of Sofia last week, which upheld a lawsuit that Nick maintained in an attempt to claim custody of the pre-embryos.

In addition to the move, the court opened documents related to the public, a reversal that had sealed the discovery in the case, according to PEOPLE.

Nick and Sofia canceled the engagement in 2014, after dating for four years. She has an adult son, Manolo, from a previous relationship and married Joe Manganiello in November 2015.

She has been in a bitter process with her ex since 2015, when he filed documents to protect and carry out two female embryos, which they created and planned to use with a surrogate belly during the relationship.

Nick filed the lawsuit in Louisiana because authorities consider embryos to be human beings, while California – where they were raised – calls them products.

Sofia and Nick signed a contract at the ART Reproductive Center in Beverly Hills when they created the embryos in 2013, which stated that neither could use them without the other’s consent.

She was sued by the embryos in 2016, when a lawsuit for the right to live was filed on their behalf in Louisiana.

The court concluded that Loeb ‘has no domicile, no residence and has no intention of being domiciled or resident in any parish in the State of Louisiana’.

In addition, the court accused Loeb’s team of ‘shopping at the forum’ to find a court that they hoped would sympathize with the case.

In addition, based on all the facts ascertained through the deposition testimony, views, sworn statements and allegations contained in the Appellant’s petition and the first amended complaint, it is clear that Mr. Loeb obviously became involved in a shopping forum when he selected , together with a member of the bar … Plaquemines Parish to institute instant action, with full knowledge that this was the inappropriate place », affirm the court records. “Their behavior brings discredit and mockery of the Louisiana legal system and the bar and is disgusting.”

Joe and Sofia met at the White House Correspondents’ dinner in 2014 and say they had visible chemistry as soon as they were introduced.

“We didn’t start dating until she was single,” Magic Mike actor told E! News. ‘I’m not trying to start a fight at the White House.’
