A married teacher accused of having sex three times with a 15-year-old student told a UK court that, at 1.50 m tall, she was “too short” for this to be possible.
Mother of three, Kandice Barber, 35, is accused of straddling the boy in his vehicle, having sex in a field and having sex with him in the forest in 2018.
But her lawyer said she was so “tiny” that it only reached the teenager’s shoulder, making his alleged antics physically impossible, The Sun reported.
The student initially denied the case, thinking he may have impregnated her – but then confessed after the Snapchat topless photos she sent him began to spread through Princes Risborough High School in Buckinghamshire, a court heard in September.
Barber has always denied the alleged calls and claimed that the intimate images were hacked from his phone.
But investigators later found a series of seemingly incriminating searches on Google, including “alibi” and “lying about where you’ve been,” reported The Sun.
On Tuesday, the jury was informed that a woman had already been convicted of sending a message to the boy a video of her performing a sexual act in his bed, according to the media.
But his lawyer, Nadia Chbat, told the Amersham courts that the alleged fights never happened.
“You told the police that you were after her. You pulled your clothes, ”she said at the age of 18. “You accept that she is very small, she is only about five feet, isn’t it, so you were taller than her at the time, weren’t you?
“You didn’t even think she could reach your shoulders at that moment, did you? Let’s just understand, you then get out of the car and walk to a small wooded area – that’s where she, you say, did oral sex on you, ”she said.
“Why did you get out of the car at all? She’s on top of you and you’re having sex in the car. What was the need to get out of the car? ”Chbat continued.
“Presumably it was just a matter of her body being moved down the area of your pants? Instead, it was decided to get out of the car and walk to the wooded area, ”she said.
“You two walk over to this wooded area and that’s when you lie down in the wooded area and say that she had oral sex on you.”
The alleged victim told the court that they had to get out of the vehicle because Barber had parked next to a busy street near his home in Buckinghamshire, The Sun reported.
The jurors also heard that Barber allegedly threatened to “topple the claimant” if he denounced her.
“You can’t make me blush when I’m teaching now, stick man”, she supposedly texted him in class, was informed to the court, according to the vehicle.
Barber denied three charges of causing or inciting a child under the age of 16 to engage in sexual intercourse and one charge of sexual communication with a child.
She also denied an accusation of causing or inciting a child to engage in sexual activity while in a position of trust, and an accusation of causing a child to watch a person’s sexual act in a position of trust.
