The passenger told police that she and the driver had an argument before an accident that killed two young children

The vehicle’s passenger, Danielle Ortiz, 23, said she and Martinez were drinking around midnight. Ortiz said he asked Martinez to take her home with his children after they argued, the complaint said.

While in the passenger seat, Ortiz told the police that she and Martinez started another argument. She said that Martinez started driving faster, hitting a barrier.

According to a criminal complaint, Ortiz’s two-month-old son, who was in a child seat, died in the accident. Martinez’s seven-year-old son, who the police said was in the back seat, also died, the police said.

Two other children were also in the car. Martinez’s other son broke his collarbone, and Ortiz’s other son had to undergo surgery to treat internal bleeding, according to the complaint.

Both women are charged with two counts of abandonment or child abuse, resulting in death, and two counts of abandonment or child abuse, resulting in major personal injury.
