Tesla fights court decision ordering CEO Musk to delete the tweet

Tesla appealed a decision by the National Labor Relations Board (NLRB), which concluded that the electric car company violated U.S. labor laws after the company fired a union activist in 2018.

In a petition on Friday, Tesla requested that the United States Court of Appeals, based in New Orleans, review the NLRB decision filed on March 25, first reported in Reuters on Saturday.

The petition further asked the court to review the NLRB’s decision to order Tesla’s CEO, Elon Musk, to delete a 2018 tweet that was deemed anti-union.

“Nothing prevents the Tesla team in our factory from voting for the union. They could do that tmrw if they wanted to, ”wrote Musk. “But why pay union dues and give up stock options for nothing?”

“Our safety record is 2 times better than when the factory was UAW and everyone already receives medical assistance,” he added.

The NLRB also instructed Tesla to offer to reinstate the dismissed employee and terminate 2017 regulations that prohibit employees from distributing union information or pamphlets without the company’s prior approval.
