Sony PS5 DualSense Drift class action lawsuit

A US law firm has already filed a class action lawsuit against Sony over the alleged diversion of DualSense control from the PlayStation 5 that some players are facing.

The lawsuit was filed earlier this week by a company called Chimicles Schwartz Kriner & Donaldson-Smith, who is also responsible for the previous Nintendo Joy-Con drift class action. Upon learning that several PS5 players were experiencing the same defect in Sony’s new DualSense controllers, he openly invited those suffering from the problem to join the case.

Accumulating enough interest, the law firm now claims that the Sony controller is “defective” as it is prone to float and move around the screen without any user intervention, which “compromises the core functionality of the DualSense controller”. It further states that Sony had prior knowledge of this phenomenon of drifting consumer complaints online, as the PlayStation 4’s DualShock 4 suffered from similar defects, but failed to rectify the problems.

“If the Claimant had been aware of the deviation defect before purchasing his PS5, otherwise he would not have purchased the PS5, or would have paid substantially less for it,” concludes the process. Sony has yet to make an official statement on the request.
