Dominion is being represented by Tom Clare and Megan Meier of Clare Locke LLP, a law firm specializing in defamation cases. In the letter to Giuliani, which was shown to CNN, lawyers warn Giuliani that “litigation on these issues is imminent”.
“With this letter, you are aware of your continuing obligations to preserve documents related to Dominion’s claims for defamation based on allegations that the company acted improperly during the November 2020 presidential election and somehow defrauded the election in favor of President-elect Joe Biden “, reads the letter to Giuliani.
Trump’s personal lawyer must adhere to the preservation request, as well as his “directors, agents, employees, partners, associates, paralegals and subcontractors under his supervision.” This also includes the contact they had with Trump campaign officials, Powell, Jenna Ellis and Lin Wood.
The letter to Cipollone also says that all communications between Trump and any White House official with Powell, Giuliani, Ellis or Wood must also be maintained.
Giuliani and the White House attorney’s office did not immediately respond to requests for comment.
Among Powell’s allegations were allegations that Dominion machines were made in Venezuela to help the country’s president, Hugo Chávez, win elections. Chavez died in 2013.
Although some of her allies tried to distance herself from her, Trump invited Powell to the White House several times and discussed naming her as a special adviser to investigate her allegations of electoral fraud, which her attorney general said he investigated and did not investigate to find evidence widespread fraud that would change the outcome of the election.
