Xavier Becerra, appointed by President Biden to head the Department of Health and Human Services, declined to name any restrictions on abortion that he would support when rigorously pressed on the subject during testimony before senators on Wednesday.
Senator Steve Daines, R-Mont., Asked Becerra point-blank if he would mention an abortion restriction he could support, which the California Attorney General refused to answer.
“Is there a line that you would draw?” Asked Daines. “Is there only one, only one restriction on abortion that you can support?”

Becerra has repeatedly acknowledged that there are many different views on this important issue – and he respects them all. But when it comes to your specific duties as Attorney General or HHS Secretary, it is your job to enforce the law.
“I tried to make sure that I am complying with the law because, be it a particular restriction or the whole idea of abortion, whether we agree or not, we have to come to some conclusion,” explained Becerra. “And this is where the law gives us a place to go.”

Daines noted that he did not get an answer and offered several options of his own, including a ban on lethal discrimination of babies diagnosed with Down syndrome or a ban on selective abortion.
“My job will be to make sure I’m following the law,” replied Becerra.
Senator Mitt Romney, R-Utah, asked Becerra about late abortions on Tuesday, where he gave similar responses.
The issue became a lightning rod for Republicans for a number of reasons, including the fact that Becerra voted against the “Partial Birth Abortion Prohibition Act” in 2003.
