Trial of Kyle Rittenhouse in fatal Kenosha shooting rejected

Rittenhouse, 18, was prosecuted on January 5 for two criminal counts of murder in the deaths of two men and one charge of attempted murder for wounding another man during street protests in Kenosha.

He faces charges that he killed Anthony M. Huber and Joseph Rosenbaum and injured Gaige Grosskreutz during the protests that followed Jacob Blake’s police shooting.

The selection of the jury for the trial was previously scheduled to begin on March 29.

“I believe that the parties are prepared together to indicate to the court that we will not be prepared on that date,” said public prosecutor Thomas Binger on Wednesday.

“There are a number of issues outstanding in the discovery, some DNA testing and some other issues that need to be resolved,” he added.

Binger also noted that “there is also some logistics regarding the eventual jury that will need to be settled”.

Rittenhouse’s lawyer, Mark Richards, agreed to the change, but said he would be open to changing the date, if possible. “If we set a date for the trial in the fall now and then go back in two months to another status – we are interested in taking this issue further,” said Richards.

Rittenhouse said he agreed to the change when questioned by Judge Bruce Schroeder. He was released on $ 2 million bail.

The final preliminary hearing is scheduled for May 17.
