The Justice Department accuses West Virginia representative Derrick Evans

A Republican member of the West Virginia House of Delegates was accused of being part of a crowd of supporters of President Donald Trump who invaded the U.S. Capitol earlier this week, the Justice Department said on Friday.

Del. Derrick Evans had filmed himself and others going to the Capitol on Wednesday. “We’re in! Keep walking, baby!” Said Evans in a video posted on social media.

Evans was accused of illegally entering the Capitol.

Evans’ lawyer said on Thursday that Evans “did not commit any criminal act that day” and that he will not resign.

The riot broke out shortly after a crowd of Trump supporters arrived on Capitol Hill after a rally where the president encouraged attendees to fight him in his effort to prevent Joe Biden from being confirmed as the next president of the United States.

Congress suspended its confirmation of the Electoral College’s vote count on Wednesday afternoon, after the crowd invaded the Capitol. But at a joint congressional session on Thursday morning, Biden’s election was confirmed.
