The Biden Justice Department asks almost all Trump-era prosecutors to resign

The Biden government will “begin the transition process” of removing all Senate-confirmed American prosecutors appointed during the Trump administration, with two exceptions, said a senior Justice Department official.

The process can start as early as Tuesday. They will be asked to resign.

John Durham will remain in office to investigate the origins of the investigation in Russia, but not as a US attorney for the Connecticut district, the official said. He was appointed a special lawyer and received extra protection for the investigation by Attorney General William Barr last fall.

David Weiss, a US attorney in Delaware, will also remain in office. Hunter Biden, the president’s son, said in December that federal authorities in Delaware were investigating his taxes.

United States prosecutors are the main federal prosecutors in their districts and are appointed politicians.

In 2017, President Donald Trump abruptly ordered the resignation of 46 U.S. prosecutors who were remnants of the Obama administration.

When Trump ordered the resignations in 2017, a Justice Department statement at the time said the action was taken “as was the case in previous transitions”.

In 1993, Attorney General Janet Reno demanded the resignation of all 93 United States attorneys in the early days of the Clinton administration.
