“On its first day in office, the Biden administration set aside immigration laws passed by Congress and suspended the removal of illegal aliens whose removal is required by those same laws,” the complaint, filed in the United States District Court for the Southern Texas District, read.
“In doing so, he ignored basic constitutional principles and violated his written promise to work in cooperation with the State of Texas to address common immigration issues,” adds the suit.
During the Trump administration, Paxton also led a lawsuit challenging the Deferred Action for Childhood Arrivals program, which protects undocumented immigrants who came to the United States as children from deportation. The case is ongoing. Paxton is also at the forefront of the most recent Supreme Court lawsuit challenging the Affordable Care Act.
Friday’s process is aimed at the Biden government’s 100-day pause in deportations. The decision to temporarily suspend deportations was made “to ensure that we have a fair and effective immigration system, focused on protecting national security, the border and public security,” according to a statement from DHS this week.
The deportation moratorium goes into effect on Friday.
