Tesla has to tell Elon Musk to delete a 2018 tweet, labor council rules

Tesla must tell CEO Elon Musk to delete a 2018 anti-union tweet, the National Labor Relations Board (NLRB) decided on Thursday. The order came as part of Tesla’s appeal of a 2019 decision by an administrative judge in a years-long legal battle between the company and the United Auto Workers union.

Tesla will also have to post a notice at its factories across the country addressing the “illegal tweet”. In fact, this is a change from the 2019 ruling decision, in which Musk or someone on the labor council would have been forced to read a notice that Tesla had violated the law.

“Here, a warning reading feature is neither necessary nor appropriate to remedy violations in this case because the Council’s traditional remedies will be sufficient to mitigate the inhibiting effect of the Respondent’s illegal conduct,” said the NLRB.

The appeal also included a number of other requests for Tesla. Notably, Tesla employees can have conversations with the media protected by the National Labor Relations Act without asking for approval. Previously, employees had a language in their confidentiality agreement that said they could not speak to the media without authorization.
