Tesla files a petition against the order of the US Labor Council

(Reuters) – Tesla Inc has filed an appeal against a decision by the U.S. National Labor Relations Council that the electric car maker violated U.S. labor laws and on the agency’s order for CEO Elon Musk to delete a tweet of the account.

The electric car maker filed a petition on Friday in the United States Court of Appeals, based in New Orleans, to review the NLRB decision and the order issued on March 25.

In the petition, Tesla asked the court to review the order and grant Tesla “any additional relief that the Court deems fair and equitable.”

Last month, the NRLB ordered Tesla to instruct Musk to delete the tweet and post a notice addressing the illegal tweet at all of its facilities across the country and include language that says “WE will take appropriate steps to ensure that Musk complies our directive. “

In the 2018 tweet, Musk wrote: “Nothing stops the Tesla team at our car plant from voting for the union. You could do that tmrw if you wanted. But why pay union dues and give up stock options for nothing? Our safety record is 2 times better than when the factory was UAW and everyone already receives medical assistance. “

The NLRB also instructed Tesla to offer the reinstatement of a former employee, as well as to rescind the 2017 rules that prohibited the distribution of union literature in its parking at non-work hours and rules that prohibited the distribution of stickers, leaflets and union pamphlets without first obtaining permission.
