PS5 DualSense Controller Drift: US Law Firm Investigating Class Action Suit

A US law firm that has already filed a class action lawsuit against Nintendo for diverting Joy-Con is now “investigating” a similar case against Sony, alleging diversion of analog control on the PS5 DualSense control. Chimicles Schwartz Kriner & Donaldson-Smith LLP created a questionnaire page, asking PS5 owners to report drift occurrences (where the console logs the stick in, even if the controller is not being touched).

“CSK & D is investigating a possible collective action based on reports that Sony PS5 DualSense controllers for the PlayStation 5 console may experience drift problems and / or fail prematurely,” says the introduction to the page. “Specifically, it is reported that the joystick on certain PS5 DualSense controllers automatically records movement when the joystick is not being controlled and interferes with gameplay.”Reports have started to emerge around alleged deviations in PS5 DualSense controllers in the past few days, although it is unclear how widespread a problem is at the moment. The CSK & D questionnaire is probably an effort to find out exactly that, before starting any formal legal proceedings.

CSK & D is in the middle of a class action lawsuit against Nintendo, which was forced into arbitration after a judge refused to try the case – a case that started with a similar user survey. It is one of a series of cases and investigations around the world about drift on Nintendo Switch Joy-Con controllers.

Recent patents have suggested that Sony may be looking to update DualSense, although these standards do not mention changes in the design of the analog stick. We rewarded DualSense with a 9/10 review, saying “Sony made a gamepad more comfortable for traditional gameplay and introduced some very interesting features.”
