Oneida County appeals the judge’s decision to deny the motion to dismiss in the Nexus Center case

UTICA, NY – Oneida County filed an appeal after a judge denied the county’s motion to dismiss an action related to the Nexus Center project in Utica.

Heuber-Breuer Construction is suing Oneida County and the Upper Mohawk Valley Auditorium Authority for $ 10 million after alleging that the entities violated their contract by misrepresenting the funds available to support the project.

The company says the county said there was a $ 49 million fund to pay for the project, which did not exist at the time the company signed the contract. The company is seeking $ 10 million for the unpaid work completed on the project.

Two of the construction company’s initial motions were rejected in November, but an amended complaint was filed in December. On February 23, the county’s motion to reject the new complaint was denied. They appealed that decision on February 25

Construction work on the Nexus Center was halted in May 2020.
