Erin Hawley filed a complaint against Patrick Young, an activist and member of the ShutDownDC group, who organized the protest, although Young told ABC News on Friday that he has not yet received the complaint.

A police spokesman told ABC News that a local magistrate found “probable cause” to issue a subpoena to Young. It is not yet known what the probable cause is.

The claim was filed in a court in Fairfax County and will be available to the public after Young receives it.

Young was charged with a misdemeanor for illegal demonstration after police told ShutDownDC at the time that it was illegal to demonstrate outside the home, ABC reported.

“If a subpoena was issued, it is outrageous that a wealthy and powerful person – a United States senator – can go to his magistrate to obtain a subpoena to harass a normal person,” said Young.

The protest took place on January 4, two days before Congressional certification for the 2020 Electoral College vote, to which Josh Hawley had announced he would object.

However, the senator was still in Missouri, so only Erin Hawley and one of his sons were in Virginia at the time of the protest.

He called the demonstration on Twitter, saying the protesters were threatening his family. However, the organizer was not charged with threats.

The protesters were present for approximately 30 minutes, singing and singing, with three of them going up to the door at any given time to deliver a copy of the Constitution.

The police at the time said they “I didn’t think it was a big deal.”

Protesters left the house after the police arrived and told them that protesting outside the house was illegal.

Erin Hawley said she was “scared” when the protesters were outside, saying they were knocking on the door and shouting.
