The husband of “Real Housewives” star Erika Jayne, Tom Girardi, is suffering from memory loss amid lawsuits and divorce, according to his brother.
Robert Girardi filed for a court order on January 13, asking that he be named guardian of his brother.
Tom Girardi, 81, is a prominent lawyer in Los Angeles and was recently hit by a lawsuit, as was Jayne, 49, claiming that they had embezzled millions of dollars from the families of the plane crash victims.
Robert Girardi said his brother is no longer able to make “rational decisions” on his own in documents obtained by Fox News that were filed in an involuntary bankruptcy case filed by creditors.
“Although at times the debtor appears to be aware of the filing of Involuntary Petitions, he needs to be reminded often,” wrote Robert Girardi. “The Debtor is unable to understand and understand the repercussions of bankruptcy proceedings pending against him and his law firm Girardi Keese.”

Robert Girardi also claims that his brother is “incompetent and unable to act on his own”.
A lawyer for Tom Girardi did not respond to Fox News’s request for comment. A call to Robert Girardi was also missed on Saturday morning.
Jayne, who is also a Broadway singer and artist, announced her divorce in November.

“After much consideration, I decided to end my marriage to Tom Girardi,” she confirmed to Fox News at the time.
The couple has been married for 21 years. In her divorce petition, Jayne asked her husband to pay court costs and provide child support. Girardi reportedly asked the court to deny the reality show star’s request.
