Cyberpunk 2077 Studio faces yet another investor lawsuit

CD Projekt Red is facing another class action lawsuit for the launch of Cyberpunk 2077, which has been plagued by bugs and controversy.

Last week, it was reported by the New York Times that the studio behind Cyberpunk 2077 may be facing a lawsuit in a regulatory process in Warsaw, Poland. Now, according to Kotaku, another lawsuit is taking place against CD Projekt Red – this one originating in the United States.

Earlier this week, Manhattan-based law firm Rosen filed a lawsuit in the Central District of California “on behalf of people or entities that bought or acquired publicly traded CD Projekt Red securities between January 16, 2020 and December 17, 2020. ” All investors who bought shares this year.

A statement in the official press release extrapolates the process:

(1) Cyberpunk 2077 it was virtually impossible to play on current generation Xbox or Playstation systems due to a huge number of bugs; (2) as a result, Sony would remove Cyberpunk 2077 the Playstation store, and Sony, Microsoft and CD Projekt would be forced to offer a full refund for the game; (3) consequently, CD Projekt would suffer damage to reputation and property; and (4) as a result, the defendants’ statements about their business, operations and prospects were materially false and misleading and / or lacked a reasonable basis at all relevant times. When the real details entered the market, the lawsuit claims that investors suffered damage.

The main plaintiff in the case is Andrew Trampe, however, the press release states that the law firm is looking for other investors to enter the lawsuit.

The launch of Cyberpunk 2077 was riddled with controversy and bugs, with the first update being introduced last week that fixed some issues. The most notable of these problems saw the saved files on the player become corrupted if they reached more than 8 MB, but fortunately Cyberpunk 2077’s The most recent patch (1.06) removed the 8 MB limit for saving files from the PC version. This is good news for the future, however, for those who have already lost their saved ones, CD Projekt Red says that, unfortunately, “this will not fix the saved saved files before the update”.

Along with the bugs that affected its launch, GameInformer’s Liana Ruppert suffered a major seizure during the game. This was due to light patterns similar to those used by neurologists to help induce seizures in patients. Later, it was also noted that the game did not have a clear warning of epilepsy at the start of the game, something that has now been fixed.

This same RPG saw its share of other controversies even before the release with reports of transphobia and crunch culture, as well as the studio also refused to share information about the game’s accessibility. Read about why we think CD Projekt Red should have confirmed Cyberpunk 2077 ′s accessibility options earlier.

According to a new report by Bloomberg, executives at CD Projekt have taken responsibility for Cyberpunk 2077 and told the team that they will receive their full bonuses, no matter how the game is analyzed. Previously, developers were told they would receive an extra payment based on the aggregate critical performance of the game represented by Metacritic.

A report released by Bloomberg yesterday found that the game’s flaws and unstable release cost CD Projekt Red founders more than $ 1 billion. Over the past week, the company’s stock has plummeted, although with no record casualties. That said, in a note to investors, the Board of Directors of CD Projekt Red stated that the game sold an additional five million copies in addition to the 8 million pre-orders, bringing the total units sold to over 13 million. This figure takes into account “returns sent by retail customers in physical stores and also in digital stores.”

Cyberpunk 2077 it is currently available for PC, Xbox One and Google Stadia. As for the PS4, retail copies are still around, but Sony has removed the game from the PSN Store. In the meantime, the official Microsoft store presents a statement alerting players to performance issues until the Xbox One version is updated. The game can also be played on the Xbox Series X | S and PS5 thanks to backward compatibility.
