– Nick Loeb lost again in his legal battle to take custody of two frozen embryos he created with ex-fiancee Sofia Vergara in 2013. An appeals court in Louisiana confirmed the rejection of Loeb’s custody process and accused him to “buy forum”, bringing the case to the state, People reports. Loeb “is not domiciled, does not maintain a residence and does not intend to be domiciled or resident in any parish in the state of Louisiana,” said the Fourth Circuit Court of Appeal. Loeb and the Modern Family star broke up in 2014 and married Joe Manganiello the following year.
The court accused Loeb and his lawyer of opening the case in an “improper location” in the hope of obtaining a favorable decision, “reports Page Six.” Their behavior brings discredit and mockery of the Louisiana legal system and the bar and is abhorrent, “wrote the court. A Loeb attorney said they plan to take the case to the Louisiana Supreme Court. The embryos are in California, and a document from the court says a 2017 case seeks “a permanent injunction to prevent Mr. Loeb from bringing pre-embryos to term without Ms. Vergara’s express written consent” is still pending.
