CD Projekt Red faces several Cyberpunk 2077 lawsuits for misleading claims

The CD Projekt Red (CDPR) is in the hot water. The company has been working on Cyberpunk 2077 for the past 8 years, just to launch the game loaded with bugs, performance issues on all platforms and graphics that were terribly inadequate on the previous generation’s consoles. In addition to attracting the ire of players who had to put up with the game’s shortcomings at launch, CDPR is also facing criticism from its investors (not to mention an inflow of refunds).

CDPR is now facing several class action lawsuits, with one being filed on behalf of investor Andrew Trampe by the law firm Rosen [PDF]. It is alleged that CDPR executives deliberately neglected to inform investors about how buggy the game was and that the company minimized other issues surrounding the game before launch.

The lawsuit alleges that public statements made about the game prior to launch “were materially false and / or misleading because they incorrectly represented [facts]”and”[CDPR] did not disclose that Cyberpunk 2077 was virtually impossible to play on current generation Xbox or PlayStation systems due to an enormous amount of bugs. “

These claims are then supported by those comments that CDPR executives made admitting their shortcomings, which we covered earlier this month:

After 3 delays, we, as the Board of Directors, were very focused on launching the game. We underestimated the scale and complexity of the problems, ignoring the signs about the need for more time to refine the game on the latest generation consoles. It was a wrong approach and against our business philosophy. Furthermore, during the campaign, we showed the game mainly on PCs.

A separate lawsuit from the Schall law firm is also seeking class action status “for violations of §§10 (b) and 20 (a) of the Securities Exchange Act of 1934 and Rule 10b-5 promulgated below by the Securities and Exchange Commission from the United States. “This process presents much of the same evidence as presented by the Rosen Law Firm, citing the various bugs and the almost impossible state of play for the previous generation’s consoles.

“Based on these facts, the Company’s public statements were false and materially misleading throughout the class period. When the market learned the truth about CD Projekt, investors suffered damage ”, says the complaint.

After its initial release, CDPR fixed a large number of bugs and performance issues on all platforms with hotfix v1.05 for Cyberpunk 2077. A separate, smaller hotfix v1.06 was released this week to fix the annoying corruption issue. of data saved on PC platforms. Looking to the near future, CDPR has major updates planned in January and February to address outstanding issues on console platforms.
