The FBI said Tuesday he arrested a man allegedly seen smoking at the Capitol Rotunda during the deadly January 6 riot.
According to an FBI complaint, a witness sent videos of Greg Rubenacker, a New York man, apparently smoking at the Rotunda during the Capitol violation. Officials said the videos were posted on Snapchat by Rubenacker.
In a clip, Rubenacker reportedly said, “Holy shit! This is history! We got the Capitol! ”In another segment, he allegedly said,” Smoke out the Capitol, baby “. According to the complaint, Rubenacker appeared to be smoking a marijuana cigarette and using a vaporizer.
A Snapchat story that appears to be from Rubenacker’s account showed protesters outside the Capitol with the caption “America is pissed.”

“The witness stated [they] He had known Rubenacker for several years and had attended school with Rubenacker, “said the FBI complaint.” His affiliate also searched the New York Department of Motor Vehicles and discovered a photograph of Greg Rubenacker’s driver’s license. According to CNBC, his lawyer replied, “Now is not the time to talk about the case.”
Rubenacker’s case was brought before a federal court in DC, the media noted, as well as all cases against people accused in connection with the violent riot.
