President Biden is “ignoring” federal law with executive immigration orders he signed since taking office, Texas Attorney General Ken Paxton said on Sunday, creating a “huge risk” for his state.
Paxton told Maria Bartiromo on Sunday Morning Futures that Biden was “out of control” and “extrapolating his constitutional role” by signing executive orders aimed at reversing the Trump administration’s immigration policies.

“You have Democrats controlling the House and the Senate so that he can make these changes,” said Paxton. “He basically doesn’t have to issue edicts from on high, ignoring federal law.”
Biden on Tuesday signed three more executive orders proposing changes in immigration, including the creation of a task force to carry out the reunification of migrants who were separated from relatives at the border, a strategy to deal with “irregular migration” at the border south, and one that will establish a review of Trump-era policies on legal immigration.
“I am not making a new law, I am eliminating bad policies,” said Biden at the time in the Oval Office.
Biden had previously signed executive orders that reversed Trump-era travel restrictions in countries considered a security risk and sought to impose a 100-day moratorium on deportations.

Paxton was the first state attorney general to sue the Biden government based on the executive order that proposed a 100-day break in deportations. The state is seeking a permanent injunction while discussing the merits of the case.
He said that Biden’s executive orders have effectively sent the message that America’s borders are open, creating a risk to his state, which shares the largest border with Mexico.
He said Texas is already battling human trafficking, drug smuggling and gang issues at the border, adding that Biden’s orders will only increase the cost of law enforcement, education and health care in the state.

“It is an unfunded mandate for my state and it is very difficult for us to assess what it will end up costing us,” said Paxton.
