Giuliani, the former mayor of New York City, voted in Manhattan for a sworn ballot, also known as a provisional ballot, after his name did not appear on voter lists when he appeared to vote.

According to records obtained by CNN’s KFile, Giuliani’s record was moved to his Long Island home in August and his New York City record was removed in September. Giuliani told CNN that he did not know why his record was transferred to his Long Island home in August and contested that he changed his record.

Giuliani swore in a sworn statement that he was registered to vote in the Manhattan district and voted there. A New York City Electoral Council official told CNN that the vote would count, citing a clause in the state’s electoral law.

Giuliani said without foundation that a large number of provisional votes taken in Pennsylvania proved cases of fraud; he further suggested that voters received provisional ballots when they came to vote, after Democrats issued fraudulent ballots on behalf of voters.

“To give another example, we have 17,000 provisional votes cast in Pittsburgh. Do you know what a provisional vote is? The provisional vote usually takes place [sic] this way, and about 15 out of 17,000 happened this way: you come in and say, ‘I’m here to vote today.’ – Oh, Mr. Giuliani, you already voted. ‘I made? I don’t remember voting. ‘ ‘Oh yes. Yes. You cast an absent vote. ‘ ‘No I did not.’ ‘Yes, you did.’ ‘No I did not.’ ‘Yes, you did,’ “said Giuliani.

Giuliani continued: “Why did it happen 15,000 times that people in Pittsburgh came to vote and had already voted, according to the Democratic electoral machine? Did they forget? Those people with bad memories in Pittsburgh? In a statement to CNN, Giuliani said he never registered to vote elsewhere and said his case was another example of electoral irregularities, if not fraud of the New York State Electoral Council.

CNN contacted the New York State BOE several times for comment, but received no response.

CNN obtained copies of Giuliani’s electoral file through open registration requests to New York State, New York City and Suffolk County electoral councils. The file also shows that Giuliani has voted by mail nine times in the past, since 2002.

The records initially indicated that Giuliani did not vote in the 2020 election, but a new poll found that Giuliani voted in Manhattan on Halloween.

Since Giuliani’s name did not appear on voter lists in New York when he appeared to vote in early Manhattan, he gave an affidavit swearing that he was registered to vote in the district in which he voted. CNN obtained a copy of Giuliani’s signed affidavit, swearing that he was registered to vote in New York City.

Although Giuliani was not registered to vote in New York City at the time, New York Electoral Board spokeswoman Valerie Vazquez-Diaz told CNN that the vote was valid and would be counted. The New York BOE pointed out a paragraph in a 2019 press release from New York Governor Andrew Cuomo’s office on historic electoral legislation on universal registration transfer, which says that when a voter moves elsewhere in the state, your registration must be “perfectly” with them.
The law stipulates that you must transfer registration and registration “to any voter who presents a ballot in a ballot envelope that establishes this new address”, effectively functioning as a way to change the voter registration on election day.
