CD Projekt faces another class action filed by investors. Like the first, the lawsuit accuses the company of practicing deceptive practices.
CD Projekt now it is facing a second class action brought by investors, and – similar to the first – the last action accuses the company of deceiving investors about the state of Cyberpunk 2077 leading to the launch. Rosen Law Firm opened the first class action lawsuit against CD Projekt on behalf of investors in late December, representing a response to the poor state in which the open world game was released, especially on state-of-the-art hardware.
Management statements indicated Cyberpunk 2077 it would provide at least one functional experience on PS4 and Xbox One consoles, and marketing materials such as trailers and game demos indicated the same. Because of this, investors are convinced that the company purposely and publicly deceived them in an attempt to maximize initial profits. Although the game certainly sold well, the controversy over its poor quality removed it from the PlayStation Store. As a result, CD Projekt’s shares also suffered. Consequently, investors sit on the receiving end of the damage. Regardless, CD Projekt plans to vigorously defend itself against the allegations presented in the lawsuit.

On its investor website, CD Projekt announced that it had received notification of another class-action civil action filed in the United States. The note further specifies that the claims in the second case mirror those of the first, in which investors accused CD Projekt of making false and misleading statements about the quality of Cyberpunk 2077 on next generation platforms. Although the claim makes no mention of any intended compensation, CD Projekt once again made clear its plans to “take vigorous action to defend against such claims. “
The second lawsuit was opened in the days following CD Projekt Red’s statement about what went wrong with Cyberpunk 2077. In a relatively long video, the co-founder of the studio, Marcin Iwiński, said that the blame for the title’s errors lies directly with management, not the developers. However, the apology video did not work in some places, due to inconsistencies about the review embargo. For some, it also looked like Iwiński threw the QA team under the bus for allegedly not encountering any of the game-breaking problems that plagued the latest generation builds. During last week’s statement, Iwiński also announced an adjustment to CD Projekt Redpost-launch plans for the title. On the one hand, the team decided to delay Cyberpunk 2077’s Free DLC in an effort to focus on stabilizing the game itself. In addition, updates for PS5 and Xbox Series X | S are now scheduled to launch on an unspecified date at the end of the year.
Cyberpunk 2077 is already available on PS4 (retail only), Xbox One, PC and Google Stadia, and will be released on PS5 and Xbox Series X / S in 2021.
