House approves resolution urging Pence to invoke 25th Amendment

The US House of Representatives voted on Tuesday to pass a resolution urging Vice President Mike Pence to invoke the 25th Amendment to remove President Trump from office.

The vote (223-205) was seen as symbolic because Pence has already said he would not take action. The House is expected to vote for the president’s impeachment on Wednesday.

The legislation was sponsored by Maryland deputy Jamie Raskin, a Democrat and former professor of constitutional law who said the amendment was intended to be the “final mechanism to remove a president who does not fulfill the basic duties of his office and, in fact, undermines the Republic with its conduct. “

Pence wrote a letter to House Speaker Nancy Pelosi, which dashed Democrats’ hopes that he would invoke the amendment.

The 25th Amendment allows the vice president and the majority of the Cabinet to consider the president unfit for the job. The powers would then be transferred to Pence.

Pence said that invoking the 25th is “not in our nation’s best interest or consistent with the constitution”.
