Miya Ponsetto, 22, of Piru, California, also faces charges of attempted robbery and theft, as well as charges of harassing a child after an incident last month in New York, the New York Police Department said by email .
Ponsetto was arrested Thursday in Piru and extradited to New York, a New York Police Department spokesman told CNN.
“The lady in this video assaulted my 14-year-old son and me when we came down from our room at @arlohotels Arlo Soho for breakfast,” wrote Harrold in an Instagram post.
Ponsetto said he lost his phone and “apparently my son got it magically,” wrote Harrold, calling the statement “ridiculous.”
It is not clear whether Ponsetto has a lawyer in this case.
She insisted in the interview that race was not a factor and that her actions were not criminal.
The NYPD said it was not investigating the incident as a case of racial prejudice.
“I was approaching the people who were leaving the hotel,” Ponsetto told CBS in an sometimes tense interview, “because, in my mind, anyone who is leaving … could be the one who is trying to steal my phone. “
