CD Projekt Red, developer of the recently launched Cyberpunk 2077, was hit by collective action on behalf of investors.
The release of Cyberpunk 2077 from CD Projekt Red was marked by a number of problems, most of which related to the performance of the video game on next-generation consoles, such as the PlayStation 4 and Xbox One. In addition to the massive reaction of consumers, the developer now also faces legal issues.
Rosen Law Firm, a New York-based firm, allegedly filed a lawsuit on behalf of investors, alleging violations of federal securities law. The lawyer said that CD Projekt Red made false claims about the recently released video game. Specifically, the developer failed to alert consumers that Cyberpunk 2077 was “virtually impossible to play” on high-end consoles. A class has not yet been certified.

The process cites conference calls, one of which took place in January. In it, the president and deputy CEO of CD Projekt Red, Adam Kiciński, assured investors that there were no problems with the latest generation version of Cyberpunk 2077, claiming, instead, that only optimization was necessary. The amount CD Projekt Red would be required to pay for the damage has not yet been revealed.
In addition to the class action lawsuit, CD Projekt Red currently faces several potential lawsuits over Cyberpunk 2077, both in the United States and in Poland. The developer released a series of statements, apologizing for the video game and promising next-generation console users that future patches would help improve the experience. A patch has already been released, but it has evidently failed to solve some of the game’s core problems.
The problems caused many consumers to request refunds from retailers. GameStop and the PlayStation Store have forced it, with the latter going so far as to remove the game entirely. CD Projekt Red had already suggested that its goal was to solve the problems and return the game to the PlayStation Store. Despite the current situation, the Polish developer reported that Cyberpunk 2077 has sold over 13 million copies worldwide, not including returned games.
Kiciński previously admitted that the developer had neglected the PlayStation 4 and Xbox One, stating: “After 3 delays, we, as the Board of Directors, were very focused on launching the game … We underestimated the scale and complexity of the problems, ignored the signs about the need for more time to refine the game on the next generation basic consoles. It was the wrong approach and against our business philosophy. In addition, during the campaign, we showed the game mainly on PCs. “
Developed by CD Projekt Red, Cyberpunk 2077 is now available on Xbox One, PlayStation 5, Xbox Series X | S, Google Stadia and PC.
