The unfortunate state of Cyberpunk 2077 has already hit developer CD Projekt Red in the wallet with Sony allowing the question-free return of PS4 copies, but the financial loss may be about to become a little more painful for the company.
On Christmas Eve, investor Andrew Trampe filed a lawsuit against CD Projekt Red for unspecified damages, arguing that the company made “false and / or misleading” statements about the game, at various points exaggerating how the title was and underestimating the volume of insects.
The claim argues that the game “was virtually impossible to play on the current generation’s Xbox or PlayStation systems due to a huge number of bugs” that led the company to suffer “reputational and pecuniary damage”.
The evidence for the complaint is a series of quotes allegedly taken literally from developer announcements and investor calls. In a conference call in November, for example, the company is quoted as acknowledging the existence of bugs, but said that “we believe the level will be so low that players will not see them”. The suit also highlights that CD Projekt Red labeled the game as “complete and playable” in January 2020, before postponing it several times.
A press release accompanying the Rosen Law Firm’s lawsuit asks investors interested in filing for collective action to contact the firm, which specializes in “global investor rights”, no later than February 22 2021.
It remains what can only be described as an ‘unstable’ first month for Cyberpunk 2077. Although the experience differs dramatically depending on the version you are playing (the PC edition has comparatively few bugs, while the latest generation hardware versions state-of-the-art software reduces performance issues with the console version), the company acknowledged that there is more work to do, with big patches promised for the coming months.
The first one – version 1.06 – arrived a few days ago and should guarantee “better management and memory stability, resulting in less crashes” on your console. It also includes a fix for a nasty PC bug where files saved exceeding 8 MB would lose all progress, although it doesn’t rescue saved games that have already been made impossible to play, unfortunately.
Not all bugs are as destructive as that one, of course. Some are just fun.
