Claudia Tenney to be declared winner in the race for the House of NY

New York Republican Claudia Tenney will be certified as the winner of the race to represent the state’s 22nd Congressional District, according to a state Supreme Court ruling on Friday.

The decision by state Supreme Court judge Scott DelConte, ordering counties and the state electoral council to certify his victory ends a three-month legal battle with another change in the House for Republicans, reducing the Democratic majority to 221-212. Tenney will remove Dep. Anthony Brindisi (D) in the first season.

DelConte criticized local electoral councils for “systemic violations of state and federal electoral law”, including the failure of Oneida County to process more than 2,400 voter requests. However, the judge decided that it is not the role of the court to rectify these errors.

“Every valid vote cast in the 22nd Congressional District of New York has been counted and counted,” wrote DelConte.

The judge also ruled that Brindisi did not prove that certification of Tenney’s victory would cause “irreparable damage”, as he has more ways to fight against certification in court.

Brindisi has already said he can appeal the decision and also has the option to challenge the election result directly in the House. He said there should be a recount and audit after what he said were “countless errors and discrepancies” in the initial count.

With such a narrow margin, the ever-changing count and the countless errors that occurred when reaching today’s final number, we cannot afford to ask us here, “he said. “It is shocking at the moment, no one knows who really won this race. My opponent and I deserve real clarity.”

Tenney is currently ahead of Brindisi by 109 votes and has a 0.035 percent lead. She won the seat for the first time in 2016, but lost to Brindisi in 2018, when Democrats had a wave election cycle. Her victory would bring the number of Republican women in the House to 30, a jump of just 13 after the 2018 elections.

Friday’s decision highlighted the success Republicans had in the House in the 2020 cycle. While observers predicted that the GOP would lose up to 15 members, the GOP ended up winning more than a dozen seats.
